CAR BAJAR VENTURES ("CAR BAJAR", "we", "our", or "us") is a car rental aggregator platform, headquartered in Ahmedabad, Gujarat, India. We connect registered drivers and agencies with users seeking vehicle rentals across India.
Partners (drivers or agencies) act as independent service providers. CAR BAJAR functions solely as a technology platform, lead generator, and payment facilitator. Nothing herein creates an employment, agency, or joint venture relationship.
To join CAR BAJAR, partners must provide valid identification, vehicle registration, insurance, and any required state or local approvals. CAR BAJAR may verify documents, bank details, and operational capability before approving a partner account.
Partners may provide vehicles for rental bookings, including self-drive or with driver services. Partners are solely responsible for:
Partners must comply with applicable laws, including the Motor Vehicles Act, Insurance Regulations, GST, and any local/state laws. CAR BAJAR is not responsible for traffic violations, insurance claims, accidents, or regulatory penalties.
6.1 Customer Payments: Payments are collected via CAR BAJAR on behalf of partners through secure gateways.
6.2 Partner Settlements: Payouts are released after completion of rental bookings, minus platform commission and any penalties. CAR BAJAR may withhold settlements in case of disputes or non-compliance.
6.3 Refunds: Partners are responsible for refunds due to cancellations, vehicle issues, or booking disputes. CAR BAJAR may process refunds on the partner’s behalf and recover amounts accordingly.
Partners must honor cancellations and ensure timely vehicle availability. Liability for compensation due to partner unavailability rests solely with the partner.
Driver Minimum Wallet Balance: Drivers must maintain a minimum wallet balance of ₹500 to ensure operational readiness and avoid service interruptions.
Partners must provide accurate pricing, avoid hidden charges, and honor the quoted rental rates. Price revisions must be communicated via the platform.
Partners retain responsibility for vehicle condition, safety, insurance, and compliance. CAR BAJAR is not liable for accidents, theft, or damage during rentals.
If partners delegate vehicle operation to third parties, they remain fully responsible for service quality, safety, compliance, and legal obligations.
Partners must maintain vehicle records, insurance documents, booking logs, and payment receipts for a minimum of 5 years and provide them for audits if requested.
Partners agree to indemnify and hold harmless CAR BAJAR and its affiliates from claims, damages, disputes, regulatory penalties, accidents, or data misuse arising from partner activities.
CAR BAJAR’s liability is limited to the commission earned on a booking. CAR BAJAR is not responsible for partner operational failures or customer disputes.
Partners must use customer data only for service fulfillment and comply with privacy laws. Misuse may result in account suspension or legal action.
Partners must maintain valid insurance (vehicle, third-party liability, and passenger coverage if applicable). Proof must be submitted upon request.
CAR BAJAR may conduct audits, verify partner compliance, request service proofs, and suspend accounts for review.
CAR BAJAR may suspend or terminate partner accounts for non-compliance, fraud, repeated complaints, or unsafe operations. Termination does not waive obligations for pending settlements, indemnity, or refund responsibilities.
Neither party is liable for delays or failures caused by natural disasters, government orders, strikes, regulatory changes, or system outages.
Disputes should first be resolved via mutual discussion within 15 days. Unresolved disputes may be escalated to arbitration under Indian laws.
These Terms are governed by Indian laws. Jurisdiction lies exclusively with courts in Mathura, Uttar Pradesh, India.
Partners may not use CAR BAJAR branding without written consent. All IP belongs to CAR BAJAR.
Partners consent to communications via email, SMS, WhatsApp, phone, or platform notifications.
Partners are responsible for GST compliance, TDS/TCS, and issuance of invoices. CAR BAJAR may deduct TDS where applicable.
24.1 Secure Payment Processing: All payments are processed via PCI-compliant gateways. Partners acknowledge that CAR BAJAR does not store sensitive card data.
24.2 Escrow & Settlements: Funds are held in escrow until completion of bookings, after which payouts are released to partners minus platform commission.
24.3 Chargebacks & Refunds: Partners must cooperate with chargeback investigations and reimburse CAR BAJAR for any validated claims. Refunds are handled according to platform policies.
24.4 Payment Dispute Resolution: Partners agree to follow the platform’s payment dispute resolution process and timelines. Failure to comply may result in withholding of settlements or account suspension.
Final Declaration: CAR BAJAR acts solely as a digital aggregator and facilitator. All operational, legal, refund, compliance, and customer dispute responsibilities remain with the partner.
